WakedUp Terms of Use

These Terms of Use ("Terms") govern your use of the WakedUp mobile application (the "App"). The App is provided by Bjeshkan Sejdiu (“we", "us", "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms incorporate Apple's Licensed Application End User License Agreement (standard EULA). Where these Terms and the Apple standard EULA conflict regarding the licensed application, the Apple standard EULA governs the license to the App.

1. The Service

WakedUp is an alarm application that requires you to complete a wake-up "mission" — such as a physical movement challenge, scanning or photographing an object, or taking a number of steps — before an alarm can be turned off. Features and missions may change over time.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.

3. Your Account

Signing in (via Sign in with Apple) is optional and is used only to keep a local profile on your device. You are responsible for activity that occurs through your device. You may delete your local profile at any time using "Delete Account" in the App's settings.

4. Subscriptions, Free Trials, and Billing

WakedUp Pro is offered as an auto-renewing subscription (for example, weekly and yearly plans). Pricing is shown in the App before purchase.
Free trial. Where a free trial is offered (for example, on the yearly plan), your subscription begins as a free trial and automatically converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
Billing. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
Manage or cancel. You can manage or cancel your subscription, or turn off auto-renew, in your Apple Account settings (Settings → your name → Subscriptions). Deleting the App does not cancel your subscription.
Refunds. Purchases are processed by Apple and are subject to Apple's refund policies. We do not separately process payments or issue refunds.

5. Acceptable Use

You agree not to: (a) reverse-engineer, modify, or create derivative works of the App except as permitted by law; (b) use the App for any unlawful purpose; (c) interfere with or disrupt the App; or (d) attempt to circumvent purchase or security mechanisms.

6. Alarm Reliability — Important Disclaimer

WakedUp is a convenience tool and is NOT a guaranteed or fail-safe alarm. You should not rely on it as your sole means of waking up for critical events.

Mobile operating systems impose limits on what apps can do in the background. An alarm may fail to sound or may be delayed for reasons outside our control, including (without limitation): the device being powered off, out of battery, in Silent/Do Not Disturb/Focus modes, the App being force-quit, the device being restarted, low-power mode, operating-system limitations (particularly on iOS versions before 26, where alarms are "best-effort"), notification permissions being disabled, volume being muted, or hardware/software issues. We are not responsible for missed alarms, oversleeping, or any resulting consequences. For anything important, use additional, independent alarms.

7. Health and Safety

Some missions involve physical movement. Use common sense, be mindful of your surroundings, and do not perform missions in a way that could cause injury. You are responsible for your own safety. The App does not provide medical advice.

8. Intellectual Property

The App, including its design, content, and trademarks, is owned by us or our licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and the Apple standard EULA.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALARMS WILL ALWAYS SOUND.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM MISSED ALARMS OR OVERSLEEPING, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the App at any time and delete it. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination (including disclaimers and limitation of liability) will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last Updated" date and, where appropriate, provide notice within the App. Your continued use after an update constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the publisher is established, without regard to conflict-of-laws principles, except where mandatory local consumer-protection laws apply to you.
